However, remote work isn't just about working from home in your pajamas or sipping coffee at a local café. It's about flexibility, which means having the ability to choose how, when, and where you work.
Flexibility in remote work is all about being able to adapt to your personal needs and the needs of your team. It means having the ability to adjust your work schedule to attend to personal matters, such as doctor appointments, school meetings, or caring for a family member. It means having the autonomy to work during the hours that you're most productive, whether it's early in the morning or late at night.
Moreover, flexibility in remote work allows you to choose the location from which you work. Whether it's your home office, a coworking space, or a beachside café, you have the freedom to choose the environment that best suits your work style and needs. This can lead to increased creativity and productivity, as you can tailor your work environment to your preferences.
The popular question that poses a lot of curiosity is- Who benefits more from this flexibility? The truth is that remote work is beneficial not only for employees but also for employers. With remote work, employers can tap into a global talent pool, hire the best candidates regardless of their location, and reduce overhead costs associated with maintaining a physical office.
The challenge now lies in finding a company that prioritizes flexibility which is very important in your career as a Remote Worker. Finding a company that places importance on flexibility requires delicate research and due diligence. It’s important to look for companies that have clear remote work policies, the right communication infrastructure in place, a focus on outcomes rather than hours worked, flexible schedules, including part-time and full-time remote work options, as well as the ability to adjust your work hours to fit your schedule, and lastly a supportive culture.
THE TERMINATION CLAUSE THAT MAKES YOU LIABLE TO YOUR EMPLOYER
As a general rule, it is not legal for an employer to ask an employee to pay the company for resigning without notice. The termination clause in a remote work contract clearly outlines the conditions and procedures under which the contract can be terminated by either party, including any notice period requirements. However, in some cases, an employer may include a provision in the employment contract stating that the employee will be required to pay the employer a certain amount of money if they resign without notice. Another instance is in some sales positions, an employee may be required to sign a contract that includes a provision for a "clawback" of commissions if they leave the company before a certain period of time. In these cases, the provision would need to be reasonable and proportionate to the legitimate interests of the employer.
Nevertheless, requiring the employee to pay a large sum of money as a penalty may be considered excessive and unfair. In some jurisdictions, an employer may be able to seek damages if an employee resigns without notice and causes the employer to suffer financial losses. However, the damages would need to be based on actual losses suffered by the employer and cannot be arbitrary or excessive.
Even in cases where such a provision exists, an employer cannot simply demand that an employee pay a specific amount of money without following proper procedures. They would need to provide written notice of the amount of money owed, along with the reasons for the deduction, and give the employee the opportunity to dispute the amount or seek legal advice.
